It is called “lemon law” because vehicles that have more than average amount of repairs and mechanical troubles are called “lemons”. What is lemon? Your vehicle is considered to be a “lemon” if it has one or more substantial defects that have been subject to a “reasonable number of attempts” to diagnose or repair the problem under the manufacturer’s warranty. The law does not cover problems caused by owner negligence or abuse, or any other modifications or alternations made to the vehicle.
What is a reasonable number of repair attempts? When one or more of the following have occurred:
  • - “serious safety defect” (has been attempted two or more times and the defect still exist)
  • - “nonconformity”  (has been attempted two or more times and the defect still exist)
  • - a vehicle has been out of service for diagnosis or repair for cumulative total of 30 calendar days
